Terms of Service

These Terms of Service ("Terms") govern your use of the Dosi mobile application and website (heydosi.com), operated by 3WB Holdings, LLC ("we," "us," "our," or "Company"). By accessing or using Dosi, you agree to be bound by these Terms. If you do not agree to any part of these Terms, do not use the Service.

1. Service Description

Dosi is a health and fitness tracking application designed to help users log and monitor peptide administration, dosing schedules, injection sites, protocols, metrics, and related health data. Dosi is provided for informational and educational purposes only and is not a medical device, diagnostic tool, or substitute for professional medical advice.

Service Tiers

Free Tier:

• Track up to 2 peptides
• Basic dose logging and scheduling
• Limited historical data retention (30 days)
• Access to educational content

Premium Tier:

• Track unlimited peptides
• Advanced scheduling and reminders
• Full historical data retention
• AI assistant ("Ask Dosi") powered by your protocol context
• Custom notes and protocols
• Health metrics integration (Apple Health / Google Health Connect)
• Data export (PDF, CSV)
• Priority customer support
• Pricing: $7.99/month or $2.99/month (founding member rate)

White-Label Clinic Partnerships:

• Custom branded version of Dosi for healthcare providers and clinics
• Setup fee: $999
• Monthly service fee: $299
• Full feature access for clinic patients
• Patient management dashboard
• Integration support
• Dedicated clinic support line

2. User Eligibility and Account Registration

• Age Requirement: You must be at least 18 years of age to use Dosi. Users under 18 are not permitted to create accounts or use the Service.
• Account Information: You agree to provide accurate, current, and complete information when registering. You are responsible for maintaining the confidentiality of your password and account.
• Account Security: You agree to immediately notify us of any unauthorized access or use of your account.
• Prohibited Users: You may not use Dosi if you are subject to sanctions, restricted from exporting, or otherwise prohibited by law from accessing the Service.

3. Acceptable Use Policy

You agree not to use Dosi for any of the following:

• Medical Advice: Requesting, providing, or interpreting medical diagnoses, treatment recommendations, or medical advice
• Illegal Activity: Using the Service to facilitate illegal activities or substances (Dosi does not endorse or encourage illegal drug use)
• Impersonation: Pretending to be another person or entity
• Harmful Content: Uploading viruses, malware, or any code intended to harm the Service
• Disruption: Attempting to disrupt, overload, or interfere with the Service infrastructure
• Unauthorized Access: Attempting to gain unauthorized access to accounts, systems, or data
• Scraping: Automated harvesting of data without authorization
• Harassment: Using the Service to harass, threaten, or abuse other users
• Spam: Sending unsolicited messages or promotions through the Service

4. Medical Disclaimer and Educational Purpose

• Dosi does not diagnose, treat, cure, or prevent any disease or medical condition
• Dosi does not provide medical, pharmaceutical, or healthcare advice
• All information provided by Dosi (including the "Ask Dosi" AI assistant) is for educational purposes only
• You assume all responsibility for evaluating the appropriateness of information obtained through Dosi
• You should always consult with a qualified healthcare provider before starting, stopping, or changing any health regimen or medication
• Dosi is not a substitute for professional medical advice, diagnosis, or treatment

5. User-Generated Data and Content

Your Responsibility

• You are solely responsible for all data you input into Dosi, including peptide information, dosing, protocols, metrics, and notes
• You warrant that all data you provide is accurate and does not infringe on the rights of any third party
• You are responsible for understanding the safety and legality of any substances or protocols you track in Dosi

Content Ownership

• You retain all rights to data you create and store in Dosi
• By using Dosi, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and store your data for the purpose of operating and improving the Service
• Your health data is not used to train AI models without your explicit consent (see Privacy Policy, Section 2)

Data Availability

• We strive to maintain uptime and data integrity, but cannot guarantee that all data will remain available indefinitely
• Users are responsible for regularly exporting their data if long-term archival is important

6. Premium Subscription Terms

Billing and Payment

• Premium subscriptions are billed monthly or as specified at purchase
• Billing occurs at the start of each billing period
• If you selected the founding member rate ($2.99/month), this rate applies for the duration of your founding membership. After cancellation, standard rates ($7.99/month) apply upon resubscription
• You agree to maintain valid payment information on file
• We accept major credit and debit cards via secure payment processors

Cancellation

• You may cancel your Premium subscription at any time through the app settings
• Cancellation takes effect at the end of your current billing period
• No refunds are provided for partial months
• Upon cancellation, you retain access to your data but revert to the Free Tier feature set

Automatic Renewal

• Your subscription will automatically renew at the end of each billing period unless you cancel
• You will be notified via email before each renewal
• Continued use of Premium features constitutes consent to be charged

Pricing Changes

• We may adjust Premium pricing with 30 days' prior notice
• Price changes will not apply to existing subscribers until the next billing cycle after the notice period

7. White-Label Clinic Partnership Terms

Partner Obligations

• Partners agree to represent Dosi accurately and in compliance with all applicable laws
• Partners are responsible for obtaining all necessary consents from their patients regarding the use of Dosi
• Partners agree to use Dosi only for legitimate healthcare provider purposes
• Partners agree not to modify, reverse-engineer, or attempt to sell the Dosi white-label platform to unauthorized parties

Data Responsibility

• Partners remain responsible for all patient data entered into their white-label instance
• Partners agree to maintain HIPAA compliance (if applicable) and all relevant healthcare privacy laws
• Partners are responsible for informing patients that Dosi is not a medical device and is for tracking purposes only

Termination of Partnership

• Either party may terminate the partnership with 30 days' written notice
• Upon termination, partners will lose access to the white-label platform
• Existing patient data may be exported upon request, subject to negotiated terms

8. Ambassador and Affiliate Program

Eligibility

• You must be at least 18 years of age to participate
• Ambassadors/affiliates must comply with all applicable advertising laws and regulations
• You agree to represent Dosi accurately and honestly in all promotional activities

Commission Structure

• Ambassadors and affiliates earn 10% recurring commission on all Premium subscriptions referred through your unique referral link
• Commissions are paid monthly via the payment method you specify
• Minimum payout threshold: $20 (commissions below this will roll over to the next month)
• Commissions are calculated based on the net revenue from subscriptions (after refunds, chargebacks, and payment processor fees)

Prohibited Activities

• You may not misrepresent Dosi's capabilities or claim it is a medical device
• You may not engage in misleading advertising or spam
• You may not use paid ads without prior written approval from the Company
• You may not poach existing customers or make unsolicited contact to Dosi users

Termination

• We may terminate your ambassador/affiliate status at any time for violation of these terms
• Upon termination, future referrals will not generate commissions
• Commissions already earned will be paid according to the payment schedule

9. Intellectual Property

Dosi Ownership

• All content, software, technology, and intellectual property within the Dosi app and website are owned by 3WB Holdings, LLC or our licensors
• This includes (but is not limited to) logos, design, code, text, graphics, and the "Ask Dosi" AI assistant
• Your use of Dosi does not grant you any ownership rights to this intellectual property

License Grant

• We grant you a limited, non-exclusive, non-transferable, revocable license to use Dosi in accordance with these Terms
• This license is personal to you and may not be shared, sold, or transferred

User-Generated Content

• You grant us the right to use, reproduce, modify, and distribute your data as necessary to operate and improve Dosi
• We will not use your personal or health data for purposes outside the scope of providing the Service, except as disclosed in the Privacy Policy

10. Limitation of Liability

• No Warranty: Dosi is provided "AS IS" without any express or implied warranties. We make no representations that Dosi is accurate, complete, error-free, or suitable for any particular purpose.
• Health Outcomes: We are not liable for any health outcomes, side effects, adverse reactions, or medical consequences resulting from your use of Dosi or any information obtained through Dosi.
• Data Loss: We are not liable for any loss, corruption, or unavailability of your data, even if we have been advised of the possibility of such loss.
• Third-Party Content: We are not responsible for external links, third-party services (including Apple Health, Google Health Connect), or content from other sources.
• Service Interruption: We are not liable for temporary or permanent service outages, downtime, or lack of availability.
• Cap on Damages: In no event shall our total liability to you exceed the fees you paid in the 12 months preceding the claim, or $100, whichever is greater. This applies to all claims, whether in contract, tort, or otherwise.

11. Indemnification

You agree to indemnify, defend, and hold harmless 3WB Holdings, LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of Dosi in violation of these Terms
• Your violation of any applicable law or regulation
• Your infringement of any third-party rights
• Your health decisions or medical outcomes related to information tracked in Dosi
• Your use of any third-party services integrated with Dosi

12. Privacy and Data Protection

Your use of Dosi is governed by our Privacy Policy, available at heydosi.com/privacy. By using Dosi, you consent to our collection, use, and storage of your data as described in the Privacy Policy.

Data Storage

• Your data is stored on Supabase servers located in the United States
• Data is encrypted in transit (TLS 1.3) and at rest (AES-256)
• We do not sell or share your health data with third parties except as required by law or disclosed in the Privacy Policy

Your Data Rights

• You may access, export, or delete your data at any time through the app settings
• Upon account deletion, your data will be permanently removed from our systems within 30 days
• You are responsible for maintaining backups of your data if needed

13. Compliance with Laws

• Dosi is intended for use in jurisdictions where health and fitness tracking applications are permitted
• You are responsible for ensuring your use of Dosi complies with local, state, and federal laws
• If you track controlled substances or engage in activities that are illegal in your jurisdiction, you do so at your own risk
• We may comply with legal requests from law enforcement or governmental authorities without prior notice to you

14. Account Termination

By You

• You may close your account at any time through the app settings
• Upon closure, your data will be deleted within 30 days (see Section 12)
• You are responsible for any outstanding Premium subscription fees through the end of the billing period

By Us

• We may terminate your account for:
  • Violation of these Terms or our Acceptable Use Policy
  • Illegal activity
  • Abuse of the Service
  • Non-payment of fees (for Premium subscribers)
  • Inactivity for 2+ years (with notice via registered email)
• Termination may be immediate or with notice, at our discretion
• Upon termination, your data will be deleted within 30 days, unless we are required to retain it by law

15. Changes to Terms

• We may update these Terms from time to time to reflect changes to the Service, legal requirements, or other factors
• Material changes will be posted on heydosi.com and via in-app notification
• Your continued use of Dosi after changes become effective constitutes acceptance of the updated Terms
• If you do not agree to changes, you may close your account

16. Dispute Resolution and Governing Law

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of laws principles.

Informal Resolution

Before initiating any legal proceeding, you agree to attempt to resolve disputes informally with us by contacting support@heydosi.com.

Jurisdiction

• You agree to submit to the exclusive jurisdiction of the federal and state courts located in St. Johns County, Florida for any legal disputes
• You waive any objection to venue or inconvenient forum in such courts

Limitation on Claims

Any legal action or proceeding related to these Terms must be filed within one year of the event giving rise to the claim, or forever barred.

17. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision will be severed, and the remaining provisions will remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and 3WB Holdings, LLC regarding the use of Dosi and supersede all prior understandings and agreements, whether written or oral.
